  1. 01 Assignment of Rents A landlord whose rent check may not be theirs to keep

    A claim that lets a lender treat the property's rental income as collateral. If the borrower defaults, the lender can collect the rent directly.

  2. 02 General Lien An unpaid obligation that has already been formalized

    A claim placed on a property because of a debt the owner owes someone else. It can arise from a court judgment, from a contract, or by operation of law.

  3. 03 Mechanics Lien Work was done on the property and the trade that did it has not been paid

    Filed by a contractor, subcontractor or supplier who provided labor or materials to improve the property and was not paid for it.

  4. 04 Utilities Lien Bills going unpaid on a property that may be sitting empty

    Filed by a gas, electric, water or sewer provider over unpaid bills or fees. Depending on state and local law the provider may also disconnect service, add penalties, or move to foreclose on the lien.

  5. 05 Divorce Two owners who both need the property converted to cash

    A claim arising from a divorce settlement, used to secure one spouse's share of the debts or assets awarded — often alimony, child support or another financial obligation.

  6. 06 Judgements A court has already ruled, and the clock is running

    A claim placed on a property as the result of a court ruling. If the debt goes unpaid, the party holding the judgment can move against the property.

  7. 07 HOA Lien Small arrears that compound fast and rarely stay quiet

    Filed by a homeowners association over unpaid assessments or charges — sometimes called an assessment lien. It gives the association a claim against the property until the balance clears.

  8. 08 Tax Government Lien The most public, most time-pressured distress there is

    Filed by a city, county or state over unpaid taxes. Property tax delinquency is the usual cause, and the taxing authority's claim sits ahead of most others.

  9. 09 Deceased Probate An estate that has to settle debts before it can distribute anything

    A claim raised during probate by the estate's personal representative, covering debts and expenses incurred before the estate is settled. It clears once the estate is distributed or the property is sold to pay what is owed.

  10. 10 Lis Pendens A dispute in progress — and a public warning attached to the title

    Not a lien in the usual sense: it is a recorded notice that litigation involving the property is under way. Anyone taking an interest in the property while it stands does so subject to the outcome.
